Open education legal issues

The aim of this course is to ensure that students know key legal issues related to open education.

Students will develop the following competences:

• Understand basic concepts of intellectual property law and take them into account in the context of open education;
• Understand the functioning of intellectual property rights;
• Respect intellectual property rights and evaluate them
• Know and understand the fundamental differences between industrial property and copyright;
• Draw up a license agreement;
• Know and respect the rules of copyright and the basic concepts of industrial property law;
• Understand the impact of new technologies on the development of intellectual property law;
• Understand the content of the free license.

There are no prerequisites.

• Introduction to Intellectual Property Law (basic concepts of intellectual property law)

Maja Ovčak Kos has in 2003 graduated cum laude at the Faculty of Law, University of Ljubljana. She was awarded the Slavko Zore award for her diploma paper. In 2005 she passed the state examination in public administration and in 2006 the state legal bar exam with excellent grades. In 2008 she finished post-graduate master's studies in civil and commercial law at the Faculty of Law, University of Ljubljana. In 2013 she received a PhD at the same faculty with the doctoral thesis Freedom of Contract and its Limitations in Copyright Law. She has been employed at the International Faculty for Social and Business Studies, Mariborska cesta 7, Celje, as the professor of higher education and researcher since 2015, where she teaches the following subjects: Commercial Law, Law in Management and The Introduction to Commercial Law in pre-graduate and post-graduate study programmes. Since February 2018 she has been employed at the University of Nova Gorica, as the Associate Professor, where she teaches Contractual Law and Intellectual Property Law. As a researcher she is the author of multiple expert legal studies, e.g. The Legal Analysis of the key Decisions of Slovenian Courts Relating to the Enforcement of Intellectual Property Right (Slovenian Intellectual Property Office), Consumer Market Study on the Functioning of the Real Estate Services for Consumers in the European Union (European Commission and Faculty of Law of University of Bremen) etc. Since 2017 she has been filling the position of an attorney at Zakonjšek Legal Firm Ltd, Mala ulica 5, Ljubljana, where she mostly deals with intellectual property law, civil law (law of torts, media law etc.) and commercial law. In March 2017 she was given the title of Lawyer-expert in Civil and Commercial Law by the Bar Association of Slovenia. She has more than fourteen years of experience in the administration of justice. She is also a mediator. As a lecturer she regularly participates in education of judges, lawyers and other legal experts (e.g. Judicial Civil Law School, Days of Property Law, etc.). She is the author of two scientific monographs and multiple scientific and professional articles as well as legal studies (e.g. The Legal analysis of the Key Decisions of Slovenian Courts Relating to the Enforcement of Intellectual Property Right) in the fields of civil law, intellectual property law as well as alternative dispute resolution.
